Terms of Use
Acceptable Use Policy — Version 1

These terms apply to anyone who registers a Merchant, Rental Operator, Organiser, or Reserve account on Qlaim (qlaim.co.za and white-labeled deployments of it), operated by Kinara Consulting (Pty) Ltd (registration number 2025/871359/07, "Kinara," "we," "us"). By creating or continuing to use an account, you ("Operator," "you") accept the declaration below. Our Privacy Policy explains separately how we handle personal information.
1. Legitimate business declaration
You confirm that you operate a lawful, legitimate business, that you are entitled to trade under South African law (or the law of your jurisdiction), and that you will use Qlaim only to sell genuine goods or services to genuine customers.
2. Prohibited uses
You will not use Qlaim, directly or indirectly, for:
- Any good or service that is illegal under South African law or the law of your jurisdiction
- Prostitution, escort services, or any commercial sexual services
- Human trafficking or exploitation of any kind
- Illegal drugs, controlled substances, or drug paraphernalia
- Unlicensed weapons, ammunition, or explosives
- Money laundering, terrorist financing, or disguising the origin of funds
- Fraud, scams, pyramid or Ponzi schemes, or misrepresenting what is being sold
- Counterfeit or stolen goods, or infringing someone else's intellectual property
- Unlicensed gambling, betting, or lottery activity
- Selling age-restricted goods (alcohol, tobacco, vapes) without the legally required age verification
- Any activity prohibited under PayFast's or Yoco's own merchant/acceptable-use policies, since Qlaim relies on these gateways to process your payments — a breach can put every Operator's payments at risk, not just yours
- Processing payments for a business other than the one disclosed on your account
3. Accurate information
You will provide accurate business details when registering and keep them up to date. Kinara/Qlaim may request supporting documentation to verify your business.
4. Your own compliance
You are solely responsible for your own tax obligations, consumer protection obligations (e.g. the Consumer Protection Act), and any licensing or regulatory requirements specific to your industry. Qlaim does not vet or license the goods or services sold through the platform.
5. No liability / indemnity
Qlaim is a booking and payment-facilitation platform. Kinara Consulting (Pty) Ltd is not a party to the transaction between you and your customers, does not endorse your business, and is not liable for your conduct, your goods or services, or disputes between you and your customers. You indemnify Kinara Consulting (Pty) Ltd against any claim, loss, fine, or liability arising from your breach of this declaration.
6. Enforcement
Kinara/Qlaim may suspend or terminate your account, withhold payouts, and — where there is reasonable suspicion of illegal activity — report you to the relevant authorities or to PayFast/Yoco, without prior notice.

Suspected misuse of the platform can be reported using the form below.
8. Changes
We may update this declaration from time to time. The "last updated" date and version number at the top of this page reflect the most recent revision; continued use of Qlaim after a change means you accept the update.
